LMIA Based Work Permit

The LMIA (Labour Market Impact Assessment) is a document that verifies that there is a need for a foreign worker to fill a job in Canada that a Canadian citizen or permanent resident cannot fill. In order to obtain a work permit under the LMIA-based program, the following steps must be taken:

Job Offers: First, the Canadian employer must provide a job offer to the foreign worker.

LMIA Application: The Canadian employer must then apply to the Employment and Social Development Canada (ESDC) for an LMIA. The employer must provide information about the job, such as the job title, duties, salary, and benefits, as well as information about their efforts to hire Canadian citizens or permanent residents for the job.

Advertising: The employer must also advertise the job in Canada for a specified time to show that they have made an effort to hire Canadian citizens or permanent residents. The advertising must meet certain requirements set out by the ESDC.

LMIA decision: The ESDC will review the LMIA application and make a decision based on factors such as the job market in the region, the employers efforts to hire Canadian citizens or permanent residents, and the foreign worker’s qualifications.

 

Work Permit Application: If the LMIA is approved, the foreign worker can then apply for a work permit from Immigration, Refugees and Citizenship Canada (IRCC). The work permit application must include a copy of the LMIA.

Processing Time: The processing time for LMIA applications and work permit applications can vary depending on the location and type of application.

It is important to note that obtaining an LMIA does not guarantee that a work permit will be issued, and foreign workers must still meet other eligibility criteria and provide the required documentation and fees to obtain a work permit.
